It can be helpful for families facing the traumatic loss of a loved one to be familiar with legal protections available to them during a difficult time. In Pennsylvania, a truck driver recently surrendered to police after being charged in the death of a worker on the Pennsylvania Turnpike. One worker was killed in the truck accident and one other worker was injured. The victim who lost his life in the truck accident was a 61-year old man. The two workers were working in a lane that had been closed off when the truck driver entered the closed lane with his tractor trailer and struck the two men in construction vehicles.
Concerning the truck accident, an assistant district attorney commented that the truck driver was speeding at the time of the accident and that he did not provide the proper amount of stopping distance for his fully loaded tractor trailer and crashed into the construction vehicles. In his comments, the truck driver advised other truck drivers to slow down.
When a victim has been harmed by a negligent truck driver, such as an inattentive truck driver or speeding truck driver, depending on the circumstances, the victim or victim’s family may be able to bring a personal injury or wrongful death claim against the responsible party for the recovery of damages associated with the truck accident. In general, criminal charges or citations arising out of an accident can be used as proof of negligence.
The unexpected loss of a loved one is devastating for any family. Because of this reality, legal options are available to help families with the different types of harm families may suffer following a truck accident.
